摘　　要：《公共图书馆法》为我国公共图书馆法治建设提供了基本遵循,对其司法适用状况展开实证研究有助于推动该法的进一步完善。以《公共图书馆法》施行后的139篇司法裁判文书为样本进行讨论,发现该法在司法实践中发挥了重要作用,但《公共图书馆法》的司法适用总体状况不容乐观,暴露出该法可操作性弱、裁判依据适用问题突出,相关主体法律意识与法律素养不足,法律适用简单化,司法适用沟通机制不畅等问题。未来,优化《公共图书馆法》的司法适用应注意以下几个方面:完善《公共图书馆法》法条设计,提升司法适用质量;增强相关主体的诉讼能力,提升裁判者业务素养;运用裁判说理方法,提升《公共图书馆法》司法适用效果;加强立法与司法沟通机制建设,完善立法后评估工作。The Public Library Law provides basic compliance for public libraries building the rule of law in China,and empirical research on its judicial application promotes the further improvement of the law.139 judicial judgment documents since the Public Library Law was implemented are studied in the paper,it is found that the law plays an important role in judicial practice,while its judicial application is not optimistic.The law is not practical,basis of the court's jurisdiction has prominent problems,relevant subjects have insufficient legal consciousness and legal accomplishment,and there also exist problems such as simplification of law application,and inadequate communication mechanism.In the future,the following aspects should be concerned to optimize judicial application of the Public Library Law:improving the legal provisions design to promote quality of judicial application;enhancing the litigation ability of relevant subjects and improve the professional accomplishment of judges;strengthening judicial application effect by reasoning of judicial judgment documents;building up communication mechanism between legislation and the judiciary and improve post-legislative evaluation.
