法秩序统一视域下侵犯著作权罪的罪质及展开

摘　　要：侵犯著作权罪理解和适用中出现的种种难题,根源于对著作权刑事保护与前置法规范之间关系的不同解读。强调著作权保护刑民衔接具有正当性,但这并不意味着对侵犯著作权罪构成要件概念必然要作出与前置法完全一致的解释。与其执拗于“著作权说”与“秩序说”之间的理论抉择,陷入法益侵害说下侵犯著作权罪质界定的“双重迷思”,倒不如转向科学界定“著作权保护不同法领域之间关系”这一更为深层次问题的探究上。在目的论层面的法秩序统一原理指导下,与著作权法通过直接赋权实现激励目的的路径不同,刑法则是通过确证著作权法规范效力,确保著作权制度发挥效能来实现激励目的。《刑法》对“复制发行”等核心概念可以作出与前置法规范不尽一致的解释,但应符合目的论法秩序统一原理的基本要求。Various difficulties in the understanding and application of the crime of copyright infringement are rooted in different interpretations of the relationship between the criminal protection of copyright and the norms of pre-law.It emphasizes the legitimacy of the connection between the criminal and the criminal in copyright protection,but it does not mean that the interpretation of the constitutive elements of the crime of infringing copyright must be completely consistent with that of the pre-law.Instead of sticking to the theoretical choice between the“copyright theory”and the“order theory”and falling into the“double myth”of defining the quality of copyright infringement under the legal interest infringement theory,it is better to turn to the scientific definition of the“relationship between different legal fields of copyright protection”.Under the guidance of the unity of legal order at the teleological level,different from the path of“Copyright Law”to achieve the incentive purpose through direct empowerment,criminal law achieves the incentive purpose by confirming the normative validity of copyright law and ensuring the effectiveness of copyright system.The interpretation of core concepts such as“copy and distribution”in criminal law is not consistent with the norms of pre-law,but it should conform to the basic requirements of the teleological law and order unity principle.
