摘　　要：推进两岸关系融合发展法治建设,是全面推进依法治国的必然要求,也是两岸关系发展新形势的客观需要。中央统一立法、地方立法先行先试以及单行法涉台条款是当前推动两岸融合法治建设的主要模式。基于涉台立法复杂性的考量,地方立法在两岸关系融合发展制度建设中仍应扮演先行先试的作用,有助于实现两岸关系融合发展法治建设的深度推进。在实施路径方面,地方涉台立法形式可兼顾授权立法与职权立法,充分发挥经济特区立法优势。立法内容应侧重落实台胞同等待遇,推动基本公共服务均等化,并通过立法质量评估以及备案审查机制实现两岸关系融合发展成果的有效落地。Promoting rule of law construction in cross-Strait integrating development is a necessary requirement for comprehensively promoting the rule of law and an objective need for the development of cross-Strait relations in the new situation.Central unified legislation,local legislation on an early and pilot basis,and Taiwan-related provisions of individual laws are the main modes of promoting cross-Strait integration and rule of law construction.On account of the complexity of Taiwan-related legislation,local legislation should still play the role of early and pilot implementation in the institutional construction of cross-Strait relations,which help realize the in-depth promotion of integrative development in cross-Strait rule of law construction.In terms of the implementation path,local Taiwan-related legislation can be a combination of enabling legislation and ex officio legislation,giving full play to the legislative advantages of special economic zones.The content of the legislation should focus on implementing equal treatment for Taiwan compatriots,promoting the equalization of basic public services,and realizing the effective implementation of the achievements of the integration and development of cross-Strait relations through legislative quality assessment and record review mechanism.
