我国商业银行金融反腐与合规管理进路——从包商银行案切入

摘　　要：近年来,我国纪检监察机关累计查获数以万计起金融腐败案件,根据中央纪委国家监委发布的有关报告:2021年以来,中管金融机构仅四大国有商业银行就至少有八名高管被公布查处。习近平总书记连续三年谈及金融反腐,表明金融腐败的危害巨大,金融安全事关国家安全,金融风险事关国民经济健康稳定运行,因此,金融反腐依然是我国当前亟需直面的严峻课题。金融腐败的本质在于监管部门与商业银行对金融业相关权力和资源的绝对垄断。相较于传统的部门监管,合规管理的优势在于依靠市场机制形成对垄断权力的制衡,并且能够直击商业银行内部的核心管理层,以更为高效地从源头抑制金融腐败行为。从部门监管到“部门+市场”多元监管思路的转变,优化商业银行合规管理体系,既是对金融腐败行为的及时预防,也是对单一部门监管的有效补充。The past years,Central Commission for Discipline Inspection(CCD)and National Com-mission of Supervision(NCS)of China have seized tens of thousands of financial corruption cases.Ac-cording to the report from NCS,eight executives from four state-owned commercial banks have been investigated since 2021.President Xi has talked about financial anti-corruption for three consecutive years,and indicated that financial corruption with great jeopardy was a matter of financial and national security and it maybe affect the stable operation of national economy.Therefore,financial anti-corrup-tion is still a serious problem that we must face directly.The essence of financial corruption roots in the absolute monopoly for power and resources.Compared to traditional departmental supervision,the advantage of compliance management is that it relies on market mechanisms to check and balance a-gainst monopoly power and to curb financial corruption at the core more efficiently.From departmental supervision to the regulatory model of department+market,optimizing the compliance management system of commercial banks is not only a prevention to financial corruption,but also an effective com-plement to departmental supervision.
