摘　　要：招标文件是整个工程招标过程中重要的法律文件,不仅规定了各项技术标准的要求还包括拟定的合同主要条款。全面、合理、专业的设置招标文件及合同条款,是投标人准备投标文件的依据,更是决定中标人后期能否顺利履约合同,维护合同双方合法权益的关键所在。目前,招标人通常选择招标代理机构委托其办理招标相关事宜。实践中,招标代理机构在招标文件编制上仍存在着各种问题与不足,因此,需要通过复盘分析并提出解决对策,全面提升招标文件的质量。Bidding documents are important legal documents in the whole project bidding process.They not only stipulate the requirements of various technical standards,but also the main terms of the proposed contract.The comprehensive,reasonable and professional setting of bidding documents and contract terms is the basis for bidders to prepare bidding documents,and it is also the key to decide whether the winning bidder can successfully perform the contract in the later stage and safeguard the legitimate rights and interests of both parties to the contract.At present,the tenderer usually chooses the bidding agency to entrust it to handle matters related to bidding.In practice,there are still various problems and shortcomings in the preparation of bidding documents.Therefore,it is necessary to comprehensively improve the quality of bidding documents through review and analysis and put forward solutions.
