大学生帮助信息网络犯罪活动罪的形成机制及防控对策——基于327例刑事案件的实证分析

摘　　要：大学生帮助信息网络犯罪活动罪日益高发,亟待积极治理。本文引入2015-2022年的327起案件,运用内容分析法,镜鉴犯罪的一般理论研究发现大学生帮助信息网络犯罪活动罪是犯罪性与犯罪机会相互作用的结果。对此应着力优化大学生的社会化历程,通过改善家庭教育、强化法治思维、提升缓刑适用率、完善社区矫正制度以降低大学生的犯罪性;借助情境预防理论,通过削减犯罪收益、升级犯罪风险、降低犯罪刺激、增加犯罪难度以实现犯罪机会的有效控制。The crime of college students helping information network crime is increasing,which needs to be actively governed.This paper introduces 327 cases from 2015 to 2022,uses content analysis method and mirrors the general theory of crime,and finds that the causes of college students'crime of helping information network criminal activities include criminality and criminal opportunity.In view of this,we should focus on optimizing the socialization process of college students,and release the criminality of college students by improving family education,strengthening the rule of law thinking,improving the application rate of probation,and improving the community correction system;with the help of situational prevention theory,the effective control of criminal opportunities can be achieved by reducing criminal income,upgrading criminal risk,reducing criminal stimulation and increasing criminal dfficulty.
