摘　　要：未成年人实施的犯罪行为以及触刑行为屡屡见诸报端,引发广泛关注,此类行为屡禁不止,与我国法律处置措施的不完善有关。虽然《预防未成年人犯罪法》已经将未成年人实施的违法犯罪行为进行分级处遇,但仍存在一些问题。通过分析我国《刑法》《刑事诉讼法》《预防未成年人犯罪法》《民法典》等法律中的不合理之处,提出相应的改善理念及具体完善措施,期望通过对未成年人犯罪行为与触刑行为处置措施的完善,达到预防未成年人违法犯罪的目的。Criminal acts and criminal offenses committed by minors are frequently reported nowadays,and this causes widespread concern.The punishments of criminal acts and criminal offenses committed by minors has been enforced many times,but these crimes stll exist.This is related to the imperfect legal measures in China.Although the Law on the Prevention of Juvenile Delinquency makes a detailed classification of different levels and types of illegal and criminal acts committed by minors,there are still some problems.By analyzing the relevant laws and regulations in China,this paper points out the unreasonable aspects in the Criminal Law,the Criminal Procedure Law,the Law on the Prevention of Juvenile Delinquency,and the Civil Code.Meanwhile,it proposes corresponding ideas of improvement and specific solving measures.It is expected to achieve the goal of preventing juvenile delinquency through the improvement of measures to deal with juvenile delinquency and criminal offenses.
