法律缺失视角下服刑人员未成年子女救助对策研究

摘　　要：服刑人员未成年子女因其父母双方或者一方在押服刑而陷入失权境地,加之国家救济权力与责任分散后有权统筹部门的缺位和上位救助法律规范的缺失以及社会救济的不足,成为处于“法律真空”地带“被遗忘”的危困群体,沦为重点青少年群体、社会不和谐因素、失依儿童以及困境儿童等多重语境下生存受困、发展受限、心理异化的边缘人。应当在坚持立法先行,完善救助法律规范的同时,反思借鉴域内外有益经验,将服刑人员未成年子女救助主体权力与责任合理分担;逐步构建起家庭抚养优先、国家主导为重、社会力量有序参与等多方主体有效介入服刑人员未成年人子女救助的多元合作救助机制。The minor children of prisoners are in a state of loss of power due to the imprisonment of both parents or one party.In addition,after the decentralization of state relief power and responsibility,the absence of the right to coordinate the department and the lack of legal aid norms of upper resue and the lack of social relief,they have become a"forgotten"group in the"legal vacum"zone,and have become a marginalized group with survival dificulties,limited development and psychological alienation in multiple contexts such as key youth groups,social disharmony factors,lost children and children in difficulties.While adhering to the principle of legislation first and improving the legal norms of rescue,we should reflect on and draw lessons from the beneficial experience inside and outside the region,and reasonably share the power and responsibility of the main body of the rescue of the minor children of prisoners;Gradully construct a diversified cooperative relief mechanism for the effective intervention of multiple subjects such as family support priority,state dominance,and orderly participation of social forces in the relief of minors.
