摘 要:从保护公民人格尊严、助力企业健康发展与人类文明发展三个方面,阐述建立反性骚扰强制合规制度的必要性。从法经济学和危险控制等理论角度,指出企业应当承担预防制止性骚扰的责任。在微观层面,分析企业构建性骚扰的预防机制、识别机制和应对机制的具体内容。在宏观层面,论述国家应尽快确立反性骚扰强制合规制度,将企业反性骚扰作为法定义务,明确相应的法律责任,还应当设立反性骚扰专门机构,加强全社会反性骚扰法治宣传,营造风清气正的职场和社会环境。This paper expounds the necessity of establishing an anti-sexual harassment mandatory compliance system from three aspects of protecting the dignity of citizens,assisting the healthy development of enterprises and the development of human civilization,and points out that enterprises should assume the responsibility of preventing and stopping sexual harassment from the theoretical perspectives of law economics and risk control.At the micro level,it believes that enterprises should build prevention mechanism,identification mechanism and response mechanism of sexual harassment;at the macro level,it believes that the state should establish a mandatory compliance system against sexual harassment as soon as possible,take enterprises anti-sexual harassment as a legal obligation and clarify the corresponding legal responsibilities.It should also set up a special anti-sexual harassment agency to strengthen the legal publicity of the whole society against sexual harassment in order to create a clean and positive workplace and social environment.
