摘  要:在《民法典》实施背景下,实现抵押权人与商品房消费者的利益平衡至关重要。在适用“执行异议和复议规定”第29条时,依据诚实信用原则,商品房消费者应尽合理注意义务。通知义务是合理注意义务的重要内容。只有商品房消费者履行了合理注意义务时,才能排除抵押权人的强制执行;反之,则不能简单地排除抵押权人的强制执行。当然,作为补救措施,商品房消费者可以代为清偿债务而消除所购商品房的抵押权负担。With the implementation of The Civil Code of the PRC,it is very important to balance the interests between mortgagees and consumers of commodity houses.In the application of Article 29 of in Enforcement Opposition and Reconseration Provisions,consumers of commodity houses shall fulfil the duty of reasonable care in accordance with the principle of good faith.The obligation of notification is important content of the duty of reasonable care.Only when consumers of commercial houses fulfil the duty of reasonable care,can the compulsory enforcement of mortgagees be excluded.Otherwise,the compulsory enforcement of mortgagees can’t simply be excluded.Of course,as a way to remedy,consumers of commodity houses can eliminate the mortgage burden of the purchased commercial houses by subrogation.
