《长江保护法》再度规范禁渔制度之必要性

摘　　要：在已有《渔业法》规范禁渔制度的基础之上,《长江保护法》再度规范禁渔制度的必要性值得探究。笔者通过文献收集、实践调研等方法,了解了长江流域禁渔制度的历史发展与法律现状,在对《长江保护法》与《渔业法》中有关禁渔制度的内容进行简要分析后,找出二者的联系与区别,最后得出《长江保护法》再度规范禁渔制度确有必要的结论。In addition to the existing Fisheries Law that regulates the fishing ban system,it is necessary to explore the necessity of revising the Yangtze River Protection Law to further regulate the fishing ban system.Through literature collection and practical research,this paper examines the historical development and current legal status of the fishing ban system in the Yangtze River Basin,analyzes the contents of the fishing ban system in the Yangtze River Protection Law and the Fisheries Law,finds out the connections and differences between the two,and finally draws the conclusion that it is necessary for the Yangtze River Protection Law to standardize the fishing ban system again.
