摘　　要：对我国疫苗接种事故侵权的特点进行总结,发现现阶段我国在对接种事故的鉴定上和对受害者的补偿上缺乏明确标准,极易引发接种单位和受害者的纠纷。而疫苗接种事故责任保险能够在接种事故发生后给予受害者及时合理的补偿,可以有效避免纠纷产生,因此我国可以通过推行疫苗接种事故责任保险的方式应对接种事故产生的风险,为我国的免疫规划保驾护航。为此,通过借鉴德国、美国应对接种事故以及我国预防接种异常反应补偿保险的相关经验,在此基础上对疫苗接种事故责任保险的推行模式、筹资模式、事故鉴定与补偿的流程进行初步设计,并提出政策建议。Summarizing the characteristics of infringement in vaccination accidents in China,it is found that there is a lack of clear standards in the identification of vaccination accidents and compensation for victims,which can easily lead to disputes between vaccination units and victims.Vaccination accident liability insurance can provide timely and reasonable compensation to victims after vaccination accidents occur,which can effectively avoid disputes.Therefore,China can respond to the risks caused by vaccination accidents by implementing vaccination accident liability insurance,providing protection for China's epidemic prevention planning.To this end,by drawing on the relevant experience of Germany and the United States in dealing with vaccination accidents,as well as the compensation insurance for abnormal response to vaccination in China,a preliminary design is made for the implementation mode,financing mode,accident identification and compensation process of vaccination accident liability insurance,and policy suggestions are proposed.
