当代政府采购法制的二元范式——以法国《公共采购法典》为例

摘　　要：中国正在根据WTO《政府采购协议》谈判形势修订《政府采购法》等相关法律制度。二阶构造之外,当代政府采购法制亦有二元范式,如法国2019年《公共采购法典》:采购主体涵盖公、私法主体,采购合同性质行、民二元,行政合同履行适用优益权与情势变更等公法规则,采购救济路径多样、覆盖广泛;面对欧盟化与全球化,法国仍将判例法写入成文法典,强势捍卫了优益权等本土规则。二元范式不仅有利于推进中国行政协议制度发展,也在一定时期内符合中国现实需求;应以政府采购法制改革为契机审慎适度拓展行政协议类型,结合本土公、私法相关规则,深化行政协议公法意义上的实质规范构造。China is currently revising relevant legal systems,including the Government Procurement Law,based on the negotiation situation of the WTO's Government Procurement Agreement.Beyond the dualistic structure,contemporary government procurement legislation exhibits a dual paradigm,as seen in France's 2019 Public Procurement Code.The procurement entities encompass both public and private entities,and the nature of procurement contracts is classified into administrative and civil contracts.Administrative contracts are subject to public law rules,such as the exercise of administrative discretion and changes in circumstances,while procurement remedies provide diverse and comprehensive paths for recourse.Facing European integration and globalization,France still incorporates case law into codified statutes,firmly defending local rules like the exercise of administrative discretion.The dual paradigm not only benefits the advancement of China's administrative agreement system,but also aligns with China's practical needs during a certain period.Seizing the opportunity of government procurement legislation reform,China should cautiously and appropriately expand the types of administrative agreements,integrating relevant local public and private law rules,thereby deepening the substantive normative structure of administrative agreements in public law sense.
