摘　　要：《最高人民法院关于为促进消费提供司法服务和保障的意见》从加强消费者权益司法保护、加强生产经营者权益司法保护、维护诚信公平的市场环境、进一步提升司法服务水平四个方面提出30条举措,对食品药品安全、预付式消费中消费者权益保护、未成年人和老年人消费者权益保护、保护生产经营者合法权益、把握好平台经济发展的红绿灯、助力数字经济和在线消费发展、营造有利于促进消费的公平竞争环境和信用机制等人民群众关心的问题作了回应。本文对意见的制定背景、制定原则、研究制定相关条款的主要考虑、理解和适用需要注意的问题等作了较为全面深入的解读。The Opinions of the Supreme People's Court on Providing Judicial Services and Safeguards for Promoting Consumption put forward 30 measures from four aspects:strengthening the judicial protection of consumer rights and interests,strengthening the judicial protection of the rights and interests of producers and other markets-partners,maintaining a trustworthy and fair market environment,and further improving the judicial services.These options have responded to the concerns of the people about food and drug safety,the protection of consumer rights in prepayment-consumption,the protection of the rights and interests of under-age and elder consumers,the protection of the legitimate rights and interests of producers and other markets-partners,guiding and regulating the development of of platform economy,helping the development of digital economy and online consumption,and creating a fair competition environment and credit mechanism conducive to promoting consumption.This article provides a comprehensive and in-depth interpretation of the background of the drafting of the Opinions,the principles of drafting,the main considerations for studying and drafting relevant provisions,and the notable issues in understanding and application.
