摘　　要：互联网技术深刻影响人们工作生活的同时,网络领域违法犯罪增幅明显。高新技术的研发与应用使得著作权犯罪手段与方式更具隐蔽性和技术性,犯罪成本降低但惩治难度增大。国际社会十分关注对著作权权利人权益的保障,一些主要的国际贸易协定如CPTPP并未将“以营利为目的”作为著作权犯罪的构成要件,扩大了刑事处罚范围。而且RCEP协定和CPTPP协定均扩展了著作权犯罪客观行为要件的手段和方式,将未经权利人授权破坏或规避他人有效技术措施的行为视为侵犯著作权行为。为应对互联网时代产业发展与著作权保护领域的不断拓展,需要适应新类型案件涉及重大法律标准创设或者改变的挑战,应重视对故意规避或破坏技术措施侵犯他人作品的行为、深度链接行为的性质以及著作权犯罪基础问题的研究,使著作权刑事保护理念与实践适应时代需求。While Internet technology has profoundly aff ected people's daily life,crimes involving internet have increased significantly.The application of high-tech have made the methods of copyright crime more concealed and technical,which results from reducing the cost of crime,increasing the difficulty of punishment on those crimes.The international community is concerned about the protection of the rights and interests of copyright holders.Some major international trade agreements such as CPTPP do not include"for the purpose of profit"as a constituent element of copyright crimes,which expands the scope of copyright crimes.Moreover,both the RCEP agreement and the CPTPP agreement have expanded the means and methods of the objective elements of copyright crimes,and regard on acts of destroying or circumventing eff ective technical measures of others without the authorization of the copyright holder as copyright infringement.In order to cope with the issues of copyright protection in the Internet era due to continuous high-tech development,it is necessary to adapt the new creation of major legal rules when facing the challenges of new types of cases.And attention should be paid to the behavior of intentionally circumventing or destroying technical measures to infringe on other’s copyright,the nature of deep linking and the research on the basic issues of copyright crimes,which makes the theory and practice of copyright infringement to meet the needs of the times.
