摘　　要：指导性案例在司法实践中被应用是案例指导制度的重要体现,以最高人民法院已发布的37批211例指导性案例作为研究对象,“北大法宝—司法案例库”中的裁判文书作为实证研究应用样本,应用人工智能技术,从多种维度对指导性案例发布和应用情况进行比较研究。在案由、地域、援引类型、应用结果等分析要素的基础上,新增指导性案例对同案由案例审判数量的影响分析。综述中通过数据分析指导性案例在发布和应用案例方面的不平衡性、明示和隐性援引的发展以及提高参照规范性方面的建议,整体呈现2022年度指导性案例司法应用的变化。The application of guiding cases in judicial proceedings is a major embodiment of the case guidance system.With the 211 guiding cases in 37 groups issued by the Supreme People’s Court as the subject of research and the adjudicative documents in the PKULAW.CN Judicial Case Database as samples of application for empirical research,this report conducts a comparative study on the issuance and application of guiding cases from various angles using AI technology.On top of the cause of action,territory,invocation type,result of application,and other elements of analysis,an analysis of impact of a guiding case on the number of cases with identical causes of action is added.The conclusion part shows changes in the application of guiding cases in judicial proceedings in 2022 by data analysis on the imbalance of issuance and application and explicit and implicit invocation of guiding cases and off ering recommendations on more standard reference to guiding cases.
