短视频著作权治理的规则研究——以卡-梅框架为视角

摘　　要：根据卡-梅框架,在选择权利保护方式时,可以依据交易成本的高低对财产规则和责任规则作出选择。短视频领域因作品确权难、著作权边界的不确定性和权利排他性,存在交易成本过高的问题。在财产规则的指引下对短视频平台施以严格的过滤义务,不能解决短视频领域许可失效的问题,还会产生严重的负外部性。相较于传统的财产规则,短视频著作权治理应打开思路,探索引入责任规则,例如法定许可、集体管理制度等许可和补偿机制。责任规则不仅可以有效降低短视频领域著作权许可的交易成本,还会为短视频用户及社会带来可观的溢出效应即正外部性。According to the C&M framework,when choosing the right protection method,the property rules and liability rules can be selected according to the level of transaction costs.In the short video field,there is a problem of high transaction costs due to the difficulty in confirming the rights of works,the uncertainty of copyright boundaries and the exclusivity of rights.Under the guidance of property rules,imposing strict filtering obligations on short video platforms cannot solve the problem of license invalidation in the short video field,and will also generate serious negative externalities.Compared with traditional property rules,short video copyright governance should open up ideas and explore the introduction of liability rules,such as statutory licenses,collective management systems and other licensing and compensation mechanisms.Liability rules can not only effectively reduce the transaction cost of copyright licensing in the short video field,but also bring considerable spillover effects to short video users and the society,that is,positive externalities.
