个人信息保护法律体系的权利基础探究

摘　　要：2021年8月20日《中华人民共和国个人信息保护法》出台,表明我国个人信息保护法律体系已初步形成,探寻何为该体系的权利基础具有了现实的意义和时间的紧迫性。大数据时代的背景下,个人与信息处理者对话和谈判力量悬殊,对个人信息保护应当采取更为强力的权利模式。然而目前民法学界提出的个人信息权与民法既有的概念存在张力。因此,应当依循《中华人民共和国个人信息保护法》中“根据宪法,制定本法”的立法提示,连接《中华人民共和国宪法》中的人权条款、人格尊严条款、通信自由和通信秘密条款,通过宪法解释的方式对个人信息受保护权予以确认,明确个人信息受保护权是个人信息保护法律体系的权利基础。The promulgation of the"Personal Information Protection Law of the People's Republic of China"on August 20,2021 indicates the personal information protection legal system has been constructed preliminarily in China.It is of practical significance and urgency to explore the basis of rights in this system.In the context of the era of big data,the power of dialogue and negotiation between individuals and information processors is disparate,and a stronger right model should be adopted to protect personal information.At present,there are contradictions between the personal in-formation right proposed by the Civil Law academic field and the present concepts of the Civil Law.Therefore,the person-al information protection right should be confirmed through the interpretation of the Constitution.That is to say,it is neces-sary to conform to the legislative reminder:"in accordance with the Constitution,this law is formulated"in the Personal In-formation Protection Law of the People's Republic of China and refer to the provisions on human rights,personal dignity,freedom of communication and confidentiality of communication in the Constitution of the People's Republic of China.It must be clarified that the right to protect the personal information is the right basis of the legal system of personal informa-tion protection.
