数字时代行政法治的结构性障碍及革新路径

摘　　要：数字技术嵌入治理场域引发了传统行政治理模式的深层次变革,构建了全新的治理范式与社会图景。立足于动态视域精准识别数字化行政的发生逻辑、结构风险和规制路径,对深刻理解数字中国战略具有理论和现实意义。数字时代的行政法治模式依循以下三重逻辑逐步变革:一是治理理念从单向管理转向多维治理,二是治理结构从封闭走向开放,三是治理权力从金字塔式的层级样态演变为流动格局。数字技术赋能行政治理引发了结构性阻碍:政府管理结构分散化与治理一体化之间的内生冲突,权力类型的异化与扩张,技术工具对个体主体性的消解。针对于此,未来数字行政法治建设应当聚焦于以下发展理路:整体主义视域下的组织重构、权力结构调适以及多元化个人权益的保障。The integration of digital technology into the governance field has brought about profound changes in the traditional administrative governance model,constructing a new governance paradigm and social landscape.Based on a dynamic perspective,this paper aims to accurately identify the generative logic,structural risks,and regulatory paths of digital administration,which is of both theoretical and practical significance for a deep understanding of the Digital China strategy.The administrative rule of law model in the digital era is gradually transforming according to the following three logics:a shift in governance philosophy from unidirectional management to multidimensional governance,a transition from closed governance structures to open ones,and a transformation of governance power from a hierarchical pyramid to a fluid pattern.However,the empowerment of digital technology in administrative governance has also created structural barriers,including the inherent conflict between decentralized government structures and integrated governance,the alienation and expansion of power types,and the erosion of individual subjectivity by technological tools.In response to these challenges,the construction of future digital administrative rule of law should focus on the following paths:the organizational restructuring from a holistic perspective,the adjustment of power structures,and the protection of diverse individual rights.
