摘  要:以《奥林匹克宪章》及其相关规则条款为研究对象,考察现代体育中运动员表达自由的规则边界。提出:基于体育自治的维护,需要对现代体育中运动员的表达自由加以限制,其基本原则可概括为“政治中立”原则、“非歧视”原则、“非商业化”原则。从核心理念、实践操作、执行效果3个维度对限制运动员表达自由的规则边界进行反思,认为:在当今百年未有之大变局背景下,国际奥委会应继续恪守“政治中立”原则、不断完善“非歧视”原则,以实现其为建设一个和平和更美好的世界作出贡献的目标。从促进我国运动员的合理表达、约束他国运动员的不当表达、科学制定与表达自由相关的体育政策3个层面提出中国策略。The boundaries of athletes'freedom of expression in modern sports are examined using the Olympic Charter and its related rules and regulations as the object of study.It argues that there should be in modern sports a need to restrict athletes'freedom of expression in terms of the sports autonomy,therefore it summarizes the three basic principles of restriction,that is,the principles of"political neutrality","non-discrimination"and"non-commercialization".In addition,the IOC should continue to adhere to the principles of"political neutrality",and to improve the principle of"non-discrimination"in order to achieve its goal of building a peaceful and better world against the contemporary background of the profound changes unseen in a century.The national countermeasures are also proposed from three levels of helping the legitimate expression of athletes,restraining improper expression of athletes from other countries,and scientifically formulating national sports policies related to freedom of expression.
