摘 要:物权公示原则的理论依据并非物权的绝对排他效力,而是立法者出于节省交易成本、降低交易风险考量的利益选择。文章认为目前占有与交付已经无法实现公示要素所应有之功能,而动产登记则有显著优势。物权是否发生变动取决于当事人的意思自治,而不应由国家强制公示方可生效,且公示对抗主义与公示生效主义在效果上并无很大区别,而选择公示对抗主义更符合公众的现实生活需求,也是民法私法自治原则的体现。动产物权变动应当以登记对抗主义为主,以转移占有为例外。The theoretical basis of the principle of property rights publicity is not the absolute exclusivity of property rights,but rather the legislators’consideration of saving transaction costs and reducing transaction risks.It’s argued that currently,possession and delivery failed to achieve the functions required for public disclosure,while registration of chattel property has significant advantages.Whether a property right undergoes a change depends on the autonomy of the parties involved,and should not be enforced by the state for it to take effect.Moreover,there is no significant difference in the effectiveness between the doctrine of public antagonism and public effectiveness,while the former is more in line with the practical needs of the public and is also an embodiment of the principle of autonomy in civil law and private law.In summary,the change of chattel property rights should be based on registration antagonism,with the exception of transfer of possession.
