论我国集体土地使用权收回的法律属性——以在法治轨道上全面建设社会主义现代化国家为背景

摘　　要：我国《土地管理法》第66条关于集体土地使用权收回的规定被广泛应用于乡村振兴、城市更新中。对于集体土地使用权收回的法律属性,即收回行为系行政行为还是民事行为,因没有明确的法律规定而引发法律适用的混乱。在我国宪制之下,集体土地使用权具有保障性、财产性、自然资源性等综合特性。这些特性为集体土地行政管理权的存在提供了物资基础和宪制基础。村集体经济组织(或村民委员会)经法律授权具有收回集体土地使用权的行政管理权,在行使收回职权时具有行政主体地位。集体土地使用权收回行为会引起行政法上的权利义务变化、具有行政行为的法效性。集体土地使用权收回的客体、主体及内容三者紧密相联,共同决定了集体土地使用权收回的行政行为法律属性。Article 66 of the Land Administration Law in China stipulates the repossession of the right to use collective land,which is widely used in rural revitalization and urban renewal.As for the legal attribute of collective land use right recovery,that is,whether the recovery behavior is administrative or civil,the confusion of law application is caused by the lack of clear legal provisions.Under the constitutional system of our country,the right to use the collective land has the comprehensive characteristics of protection,property,natural resources,etc.These characteristics provide material basis and constitutional basis for the existence of collective land administrative right.Village collective economic organizations(or villagers’committees)are authorized by law to have the administrative power to recover the right to the use of collective land,and have the administrative subject status when exercising the power to recover.The act of retaking collective land use right will cause the change of rights and obligations in administrative law and has the legal effect of administrative act.The object,subject and content of the collective land use right recovery are closely linked,which together determine the legal attribute of the administrative act of the collective land use right recovery.
