摘　　要：所有权保留制度广泛应用在一些大宗货物或者不易损耗的消费品买卖中,例如房屋买卖、汽车买卖、大型家用电器的买卖,且通常以分期付款的形式表现出来,但其实质上仍是所有权保留的买卖合同。所有权保留制度对买卖双方都有很大的益处:一方面买受人只支付少部分对价便可以购买价格很大的商品并提前使用标的物,增强了消费者的购买力;另一方面,由于买受人购买力的增强,消费品的需求也就有所扩大,商品的销路随之扩张。这也就是为什么在所有权保留买卖中出卖者一方虽然要承担非常大的风险仍然会有许多商家愿意使用这一制度的原因。The retention-of-title system is widely used in the sale of some bulk goods or non-destructive consumer goods,such as the sale of houses,the sale of cars,and the sale of large household appliances,and is usually expressed in the form of installments,but it is still essentially a retention-of-title contract.The retention-of-title system is of great benefit to both buyers and sellers:on one hand,buyers can buy high-priced goods and use the subject matter in advance by paying only a small part of the consideration,which enhances the purchasing power of consumers;on the other hand,due to the increased purchasing power of buyers,the demand for consumer goods has expanded,and the sales of goods expands.This is why although the seller has to take great risks in retention of ownership,there are still many businesses willing to use this system.Because the seller has to bear greater risks,this article mainly studies the seller’s right to remedy in case of breach of contract.
