摘　　要：自1995年颁布施行后首次大规模修订的《中华人民共和国体育法》新增设立“体育仲裁”专章规定,填补了我国体育仲裁制度的法律空白。文章采用文献资料、规范分析等方法,提出新生的体育仲裁制度存在受案的范围边界不清、特别程序适用条件不明和临时措施规范供给不足等争议,亟待在实践中进一步探索发展。鉴于体育纠纷的特殊性,应完善仲裁程序规则,在实践中厘清体育仲裁的受案范围,明确特别程序的适用条件并补充规范临时措施,从而发挥制度优势、推动体育善治。The Sports Law of the People's Republic of China,which has been revised in large scale for the first time since its promulgation in 1995,has added a special chapter on "sports arbitration" to fill the gap in China's sports arbitration system.By means of literature and normative analysis methods,this paper points out that there are some disputes in this newly established system,such as unclear scope of accepting cases,ill-defined application conditions of special procedures and insufficient supply of provisional measures,which need to be further explored and developed in practice.In view of the particularity of sports disputes,the rules of arbitration procedure should be improved,the scope of accepting cases of sports arbitration should be elucidated in practice,the conditions for the application of special procedures need clarification,and provisional measures should be supplemented to standardize the system,so as to give full play to the advantages of the system and promote good sports governance.
