摘  要:基于科罗拉多河近70年的水权分配具体历程,结合亚利桑那州在科罗拉多河水权分配中的角色和作用以及洛杉矶-欧文斯河谷水权案例,总结科罗拉多河在水权边界、法律体系、水权分配、水权管理和生态水权五方面的制度建设经验,结合长江流域水情区情,提出科罗拉多河水权制度建设可对长江上游流域水权制度建设在六个方面的借鉴和启示,一是水权分配要因时因地,二是水权分配要统筹上中下游,三是水权实现需要工程支撑,四是水权实现需要考虑优先权,五是水权管理要重视生态水权,六是水权管理应推动公众参与。Based on the specific course of water right allocation of the Colorado River in the past 70 years,combined with the role of Arizona in the water right allocation of the Colorado River and the Los Angeles-Owens Valley water right case,this paper summarizes the experience of institutional construction of the Colorado River in five aspects:water right boundary,legal system,water right allocation,water right management and ecological water right.According to the water situation of the Yangtze River Basin,it is proposed that the construction of water right system of the Colorado River can be used for reference and inspiration in six aspects for that in the upper reaches of the Yangtze River.First,the distribution of water right should be accorded with different time and place.Second,the distribution of water right should be coordinated in the upper,middle and lower reaches.Third,the realization of water right needs engineering support.Fourth,the realization of water right needs to consider priority.Fifth,water right management should pay attention to ecological water right.Sixth,water right management should promote public participation.
