摘　　要：从我国目前的区域协同立法实践来看,区域协同立法存在着动力不足的现实困境,主要体现在现有的协同立法成功样本较少、协同立法对区域社会经济发展推动作用有限以及地方政府官员从事协同立法的积极性不足。造成区域协同立法动力来源不足的主要原因在于,区域立法合作协议的约束力较弱,同一区域范围内地方利益协调难度较大,区域社会经济一体化有待进一步加强。为此,需要引入新区域主义理论,以优化其动力来源。在新区域主义理论看来,一方面,需要健全区域利益共享和补偿机制,强化区域协同立法的外在动力;另一方面,改善现有的政绩考核模式,激发区域协同立法的直接驱动力。另外,还要注重地方自下而上的推动力量,尽可能地扩大民众的参与力度,强化区域协同立法的根本动力。三者之间相互协调配合,形成合力,以便推动区域协同立法更好的发展。From the current practice of regional collaborative legislation in China,there is a realistic dilemma of insufficient power in regional collaborative legislation,which is mainly reflected in the few successful samples of existing collaborative legislation,the limited role of collaborative legislation in promoting regional social and economic development,and the lack of enthusiasm of local government officials in collaborative legislation.The main reason for the lack of power source of regional collaborative legislation is that the binding force of regional legislative cooperation agreements is weak,the coordination of regional interests is difficult,and the regional social economy needs to be further developed.Therefore,it is necessary to introduce the theory of new regionalism in order to optimize its power source.According to the new regionalism theory,on the one hand,it is necessary to improve the regional interest sharing and compensation mechanism and strengthen the external driving force of regional collaborative legislation.On the other hand,it is necessary to improve the existing performance evaluation model and stimulate the direct driving force of regional collaborative legislation.In addition,it is also necessary to pay attention to the bottom-up driving force of the local government and expand the participation of the people as much as possible,Strengthen the fundamental driving force of regional collaborative legislation,coordinate and cooperate with each other to form a joint force,so as to promote the better development of regional collaborative legislation.
