数字时代儿童个人信息安全保护的困境与出路

摘　　要：在我国互联网持续发展的大背景下,儿童触网年龄显著降低,其个人信息极易遭到泄露和滥用。为了保护儿童权益,应从儿童特殊保护和信息分类管理的角度研究其规制路径,结合《中华人民共和国个人信息保护法》有效规制侵害儿童个人信息权益的行为。但当前监护同意的适用条件不够明确;此外,刑法保护机制缺位、儿童个人信息管理制度不健全等问题也亟待解决。对此,应当逐步构建起民刑一体的儿童个人信息保护体系,进一步提升儿童个人信息保护的位阶;同时细化监护人同意制度,并根据儿童个人信息在识别、收集、利用以及储存的不同阶段制定严格的信息管理规则,进而高效保护儿童个人信息安全,为儿童健康用网护航。Under the background of the continuous development of the Internet in China,the age of children's accessing the Internet is significantly reduced,and their personal information is vulnerable to leakage and abuse.To protect children's rights and interests,we should study the regulation path from the perspective of special protection of children and information classification management,and effectively regulate the infringement of children's information rights and interests in combination with the Personal Information Protection Law of the People's Republic of China.However,the applicable conditions of the current guardianship consent are not clear enough.In addition,such issues as the absence of criminal law protection mechanism and unsound children's personal information management system also need to be resolved.In this regard,we should gradually build a civil and criminal system to protect children's personal information,and further enhance the level of children's personal information protection;at the same time,the guardian consent system should be refined,and strict information management rules should be formulated according to the different stages of identification,collection,utilization and storage of children's personal information,so as to effectively protect children's personal information security and escort children's accessing the Internet.
