摘　　要：针对《海安法》第96条对“未依法悬挂国旗”处罚数额较大的情况,从海事部门具体实施情况入手,分析了面临的困境与成因以及执法部门存在的误区,提出以包容审慎监管为指引的法律实施建议。In view of the large amount of fine for"failing to fly the national flag"in Article 96 of the Maritime Safety Law,and proceeding from the specific implementation of the maritime administration,this paper analyzes the relevant difficulties and the causes,and the misunderstandings existing in the law enforcement departments,and puts forward suggestions on law implementation under the guidance of the inclusive and prudent supervision principle.
