印度尼西亚巴塘项目合同管理模式研究

摘　　要：项目合同本身就是法律文件,合同中的所有条款都是合同各方必须严格遵守、自觉履行的法律责任。合同各方对合同条款的正确解读和使用不仅考验承包商是否能够充分利用合同来维护自身合法权益的能力,更是考验承包商是不是有经验的承包商。以印度尼西亚巴塘项目充分利用合同条款,合理合法的修正因业主根据其自己对合同的片面理解,并炮制的所谓“双监理”机制的实例,探讨了正确解读和使用合同条款的重要性,以及敢于向业主有理有据“亮剑”的精神。The contract itself is a legal document,and all the terms in the contract are legal responsibilities that all parties to the contract must strictly abide by and consciously perform.The correct interpretation and use of the terms of the contract by the parties to the contract not only tests whether the contractor can make full use of the contract to protect its legitimate rights and interests,but also tests whether the contractor is an experienced contractor.Taking full advantage of reasonable and legal amendments to the contract terms in the Batang Project in Indonesia,this paper exposes that the so-called"double supervision"mechanism was concocted by the owner based on his own one-sided understanding of the contract,and celebrates the spirit of resistance.
