农村土地信托中地方人民政府的角色调适与制度回应

摘　　要：在农村土地信托实践中,基于不同的现实环境与目标考量,地方人民政府选择的农村土地信托流转路径不尽一致,其角色定位可能存在“失当”问题。为了调适农村土地信托中地方人民政府的角色定位,应当将是否有助于实现农村土地信托目的、是否有利于克服农村土地信托中的市场失灵以及是否有利于扩大农村土地信托规模等作为地方人民政府角色定位的判断准据。从尊重和保障土地承包经营权主体的意思自治、不应成为农村土地信托关系中任何一方当事人以及作为农村土地信托中“公共物品”提供者等方面入手,可以对地方人民政府的角色调适作出相应制度回应。In the practice of rural land trust,local governments choose different paths of rural land trust transfer in consideration of different realistic environment and objectives,and then local governments may play“improper”roles.The role orientation of local government in rural land trust should be adjusted,and the judgment criterion should be whether it is helpful to the realization of the purpose of rural land trust,whether it is helpful to overcome the market failure in rural land trust,and whether local government’s participation in rural land trust is actually effective and so on.The corresponding institution should respond to respecting and guaranteeing the autonomy of the subjects of land contract and management rights,not being any party in the land trust relationship,and being the provider of“public goods”in the land trust.
