摘 要:宪法是区域协同立法权的行使依据。区域协同立法需要遵循宪法上的中央统一领导、国家机关工作提质增效和社会主义市场经济原则。宪法上的人民主权、发挥地方主动性和积极性,以及地方性法规的制定权是区域协同立法的宪法依据。从我国的立法实践来看,作为区域协同立法依据的“区域协调发展的需要”具备特定的规范内涵,包含了制度事实和社会事实两方面的内容。区域协同立法的合宪性控制要在实体上坚持区域利益与国家利益并重的原则,在程序上区分直接管理事务和间接管理事务,对前者的协同立法主要依靠事后的备案审查机制,对后者的协同立法侧重于在事前通过宪法解释进行合宪性控制。The exercise of regional collaborative legislative power needs to be based on the Constitution.Regional coordinated legislation should follow the principle of unified leadership of the central authority from the Constitution,of improving the quality and efficiency of the work of state organs,and of the socialist market economy.Regional coordinated legislation is constitutionally based on the constitutional popular sovereignty,the initiative and enthusiasm of local governments,and the legislative power of local governments to formulate local laws and regulations.From the perspective of China's legislative practice,“the need for regional coordinated development”,as the legislative basis for regional coordination,has specific normative connotation,which includes both institutional facts and social facts.The constitutionality control of regional collaborative legislation should adhere to the principle of paying equal attention to regional interests and national interests in entity,and distinguish between directly managed affairs and indirectly managed affairs in procedure.The former's collaborative legislation mainly relies on the post filing review mechanism,while the latter's collaborative legislation focuses on constitutionality control through constitutional interpretation in advance.
