摘　　要：【目的】结合域外立法,分析局部外观设计的权利范围、侵权判定主体、相似性判断标准,为局部外观专利侵权判定规则的完善建言献策。【方法】以外观设计侵权判定的构成要件为检视对象,结合局部外观设计的特点,逐一与构成要件比对,进一步考察外观设计专利侵权判定规则在局部外观设计上的适配性。同时对部分具有典型价值的域外立法进行分析。【结果】解除“相同或者近似产品”的限制,重塑“一般消费者”定义并调整适用现有权利保护范围,或许是一种满足局部外观设计侵权判定实践需求的有效方法。【结论】局部外观设计制度这一新生客体的引入将会对外观专利司法救济产生重要影响,但是目前尚未达成相对统一的裁判标准,需要灵活调整局部外观设计的权利范围、侵权判定主体、相似性判断标准,建立具有一定实用性和合理性的判断规则。[Purposes] Combined with extraterritorial legislation,this study analyzes the scope of rights,infringement determination subjects,and similarity judgment standards of partial designs,and provides suggestions for the improvement of local design patent infringement judgment rules.[Methods] Taking the constituent elements of design infringement determination as the object of examination,combined with the characteristics of partial designs,and comparing them with the constituent elements one by one,the suitability of design patent infringement determination rules in local designs is further investigated.At the same time,some extraterritorial legislation with typical value is analyzed and referenced.[Findings] Lifting the restriction of "identical or similar products",reshaping the definition of "general consumer" and adjusting the scope of protection of existing rights may be conductive meet the practical needs of local design infringement determination.[Conclusions] The introduction of the partial design system,a new subject matter,will have an important impact on the judicial remedy of design patents,but at present,a relatively unified adjudication standard has not yet been reached,and it is necessary to flexibly adjust the scope of rights,infringement judgment subjects,and similarity judgment standards of partial designs,and establish judgment rules with certain practicality and reasonableness.
