摘　　要：农药行政执法实践中经常遇到农药的认定问题,对于某一个产品能否纳入农药管理范畴,仍困扰着不少一线农药执法者。本文依据农药法规、规章和农业农村部公文,结合农药执法实践,对行政执法中如何认定为农药提出了应当遵循的原则和意见,供执法人员参考。The enforcement of pesticide administrative law often presents challenges when identifying certain"pesticides"with unique characteristics,such as bird repellent,fertilizer,special chemicals,and substandard products.Determining whether a particular commodity or sample falls under pesticide management,and how to make such judgments,remains a perplexing task for many front-line agricultural law enforcement officials.In response,the author has developed a comprehensive process for qualitative assessment of pesticides,intended as a reference tool for agricultural law enforcers.This process is derived from a thorough examination and analysis of relevant laws and regulations,official announcement from the General Office of the Ministry of Agriculture and Rural Affairs,and various agricultural law enforcement cases.
