摘　　要：农药企业在对专利化合物制备工艺研究创新的同时,随着新的工艺常常产生新的农药中间体,但是由于国内企业对中间体专利申请或审查标准的理解存在误差,往往仅保护化合物制备工艺,而未能同时对中间体进行保护,造成企业在知识产权上的流失。结合《专利审查指南》和相关案例研究,探索农药化合物中间体专利审查标准,希望能够为农药企业保护农药新工艺中涉及的中间体专利提供借鉴。Pesticide companies often generate new pesticide intermediates with new processes while researching and innovating the preparation process of patented compounds.However,due to errors in the understanding of intermediate patent applications or examination standards,domestic enterprises often only protect the compound preparation processes without simultaneously protecting the intermediates,resulting in the loss of intellectual property rights for enterprises.Based on the Guidelines for Patent Examination and related case study,this paper explores the patent examination standards for pesticide compound intermediates,hoping to provide references for pesticide enterprises to protect intermediates involved in new pesticide processes.
