摘　　要：个人信用信息权益保护是社会信用体系建设中的关键内容。人工智能工具的使用,既为社会信用的数据治理提供了有力支持,又带来了信用主体隐私权、名誉权等实体权利受到侵犯的风险以及信用主体知情权、异议权等程序权利难以实现的隐患。同时,还存在信用监管权受到算法侵蚀,监管范围被征信机构技术规避的问题,也将进一步加大个人信用信息权益受到损害的风险。应对如上问题,约束替代数据的采集利用、提升算法过程透明度、修建完善失信惩戒与信用修复机制,是可行之道。此外,增强提供者和用户监管在人工智能技术支持的信用信息权益保护和社会信用体系建设中的作用,是关键之策。Protection of the rights and interests of personal credit information is a key element in the construction of social credit system.The use of artificial intelligence tools not only provides powerful support for data governance of social credit,but also brings the risk of making the substantive rights of credit subjects,such as privacy and reputation rights,infringed,and the hidden danger of making the procedural rights of credit subjects,such as the right to know and the right to object,difficult to realize.At the same time,the erosion of credit regulation rights by algorithms and the problem of the regulatory scope being technically circumvented by credit agencies will further increase the risk of damage to the rights and interests of personal credit information.To cope with such problems,it will be feasible to restrain the collection and utilization of alternative data,enhance the transparency of the algorithm process,and build a perfect mechanism for disciplinary and credit repair for breach of trust.In addition,enhancing the role of providers and users supervision in the protection of credit information rights and interests supported by artificial intelligence and the construction of social credit system will be the key policy.
