摘 要:在跨境电商交易中,供应链管理第三方物流基于其特性,可以根据客户的需要,实现客户的差异化和利益最大化。在这一进程中,除了依靠物流产业本身,还需要结合物流和法律两个领域的有关理论,为其制定出有意义的保障和制约机制。在实际工作中,大部分第三方物流的争议来自物流合同。文章通过对第三方物流法律含义的阐释,厘清了我国跨境电商中第三方物流的法律现状,并进一步建议建立第三方物流的管理框架,同时也对我国跨境电子商务第三方物流合同的法律属性进行了探讨。通过对以上相关问题的分析,明确了相关当事人的责任,并提出了相应的解决措施,以期能为解决第三方物流法律问题提供一定的理论经验。In cross-border e-commerce transactions,supply chain management third-party logistics can achieve customer differentiation and maximize benefits according to customer needs,based on its own unique characteristics.In this process,in addition to relying on the logistics industry itself,it is also necessary to combine the relevant theories of logistics and law to develop a meaningful guarantee and restriction mechanism for it.In practice,most of the third-party logistics disputes come from the logistics contracts.By explaining the legal meaning of third-party logistics,this paper clarifies the legal situation of third-party logistics in cross-border e-commerce,and further suggests to establish the management framework of third-party logistics;this paper discusses the legal nature of third-party logistics contracts in cross-border e-commerce in China.Through the analysis of the relevant problems,the responsibilities of the relevant parties are clarified,and the corresponding solutions are put forward to provide theoretical experience for the solution of third party logistics law issues.
