摘　　要：本文从知识产权的大国战略博弈出发,以中美关系为切入点,对全球经济体系现代化进程中知识产权制度的演进过程及变迁内因进行比较研究和历史事件分析。研究发现,工业革命以来的近现代历史中,知识产权成为先发国家保护个体创造动力、激发市场经济活力、助力科技企业发展的国内公共政策工具;而当代知识产权的制度属性发生了异化,即从国内政策演化为国际政治安排,逐步融入相关国家维系技术霸权、打造贸易壁垒、维系长期竞争力的大国战略之中。新时期全球战略格局的高度不平衡性、不确定性与复杂性,将使知识产权制度更深刻影响中美关系发展,基于知识产权的相互依存将会成为实现两国战略安全平衡的重要基石。在此基础上,以中国推动高质量发展、实现高水平科技自立自强为立足点,提出新时期中国知识产权制度建设的政策建议。The creation and effective utilization of knowledge is the foundation of national capacity,particularly in contemporary society where the knowledge economy places unprecedented emphasis on knowledge.Contemporary scholars explain the reasons for the "rise of the Western world" from the perspective of economic history.The core consensus is that efficient economic organization is the key to economic growth,and the development of the property rights system in Western Europe is the reason for the rise of the Western world.However,the existing literature on China-US relations rarely provides game ideas and strategic thinking from the perspective of intellectual property rights,especially lacking traceability research on the historical evolution and politicization evolution of the intellectual property rights systems between China and the United States.This study sorts out the historical context of knowledge as a "property rights system" in detail,focuses on the analysis perspective of the strategic game between China and the United States,and makes a comparative study and a historical event analysis of the evolution process and internal causes of intellectual property rights system in the modernization process of the global economic system.It is found that intellectual property right is essentially the consensus of human society on the market value of knowledge and its exchange and sharing rules.In modern history since the Industrial Revolution,the establishment of the intellectual property rights system has become a domestic public policy tool for the first movers to protect the creative power of individuals,stimulate the vitality of the market economy,and boost the development of science and technology.In contemporary times,the institutional logic of intellectual property rights has evolved from a domestic policy to an international political arrangement and integrated into the competition strategy of relevant countries to maintain their technological hegemony,build trade barriers,and maintain long-term competitivene
