摘  要:"烂尾楼"工程涉及多方利益和占用大量的资源,事关社会稳定与金融安全,复工续建利大于弊,解决好"烂尾楼"工程的复工续建具有现实的意义。但复工续建过程中面临着引入资金困难、工程所涉法律关系复杂、各方主体难以协调和续建过程难以管理等难题。文章通过研究积极探索多元融资模式、理清法律关系和清偿顺位、推进府院联动、各方协调和加强管理人的选任和监管等方法破解"烂尾楼"工程的拯救难题,减少"烂尾楼"工程对社会、经济造成的负面冲击。"Unfinished building" projects involve multiple stakeholders,occupy huge resources,and relate to social stability and financial security.The advantages outweigh the disadvantages in resuming construction of "unfinished building" projects,the proper handling of which is of practical significance.However,there are tricky problems such as difficult financing,complex legal relations involved in projects,difficulty in coordinating all participants,and trouble managing the process of continuing with construction in the process of resuming construction.This paper tackled tricky problems in saving "unfinished building" projects by studying methods such as actively exploring diversified models of financing,straightening out legal relations and the order of liquidation,promoting collaboration between the government and the court of law,coordination of all parties,and strengthening the selection,appointment and supervision of managers,to reduce negative impacts of "unfinished building" projects on society and economy.
