摘　　要：完整、全面的“上游打击、中游遏制和下游康复”反恐体系,需关注对恐怖主义的文化治理。恐怖主义是组织严密的文化输出现象,恐怖属性的文化是个体激进化、极端化和恐怖分子化的主要因素,恐怖事件的发生也有深厚的文化动因驱使。恐怖主义本质上先于恐怖主义行为、恐怖事件而发生,限于调整范围,刑法难以在思想层面控制和根除恐怖主义的蔓延。治理关键在于正视恐怖主义作为一种文化暴力对秩序的根源性破坏,要强化对文化安全的保障,健全文化安全防范机制,对恐怖主义的传播加以主动干预、全面遏制,减少个体感染风险。安全防范机制的体系包括规范体系、识别机制、预警机制、甄别机制和阻断机制。同时,文化安全防范机制潜藏着侵犯文化自由的泛化风险,文化治理应在法治原则、人权原则、比例原则、群众原则的价值理性控制下实现全体社会成员更有尊严的安全保障。In order to form a complete and comprehensive anti-terrorism system of"upstream attack,midstream containment and downstream rehabilitation",we should pay attention to the cultural governance of terrorism.Terrorism is a well-organized cultural export phenomenon,terrorist cultural attributes are the main factor of individual radicalization,extremism and terrorism,and it is also driven by profound cultural motivations.Terrorism essentially occurs before terrorist acts and incidents.Limited to the scope of adjustment,it is difficult for criminal law to control and eradicate the spread of terrorism at the ideological level.For the governance of terrorism,we should regard terrorism as a radical damage of cultural violence to the order,strengthen the cultural security guarantees,and improve the mechanism of cultural security to proactively interven the spread of terrorism,and comprehensively contain,and reduce individual risk of being brainwashed.A systematic security prevention mechanism includes specification,recognition,warning,identifying and blocking.It should be noted that the cultural security represented by the mechanism underlies the risk of encroachment on cultural freedom.Therefore,cultural governance should follow the principle of the rule of law,human rights,proportionality,mass and other value rationality to ensure the security of all members of society with more dignity.
