纯正行政犯轻刑化初论

摘　　要：风险社会的不期而至,使得刑事立法步入活性化时代,尤以行政犯的扩张为显性标志。立足于我国违法犯罪二元治理体系,相当的犯罪化是我国应对社会风险的积极选择;着眼于世界刑罚轻缓化改革趋势,相当的轻刑化是我国刑罚现代化改革的应有之义。经由“行政犯—刑事犯”的类型再区分与“犯罪化—轻刑化”的耦合得出“纯正行政犯轻刑化”这一命题。在依据证成上,纯正行政犯具有自身的轻刑逻辑与现实基础,纯正行政犯轻刑化根本上是由其犯罪本质所决定,其扩张态势、刑罚结构性缺陷以及较强的社会感刑力是其轻刑化的现实基础。在路径构建上,不仅要完善纯正行政犯轻刑化的制度供给,而且要强化纯正行政犯轻刑化的司法适用,还应推动纯正行政犯刑罚执行的社会化。The unexpected arrival of a risk society has made criminal legislation enter an era of activation,especially the expansion of administrative offenders.Considerable criminalization is an inevitable choice for China to deal with social risks and challenges under the dual governance system of illegal and criminal crimes;and the tendency of considerable light punishment should be a part of China s modernization reform of criminal penalty.The second type distinction of“administrative offenders—criminal offenders”and the coupling of“criminalization—light punishment”leads to the proposition of“light punishment for pure administrative offenders”.In terms of evidence,pure administrative offenders have their own logic and practical foundation of light punishment.The light punishment of pure administrative offenders is fundamentally determined by their criminal nature,and their expansion trend,structural defects in punishment,and strong social sensitivity are the practical foundation of their light punishment.In terms of its path construction,we should not only improve the system supply of light punishment for pure administrative offenders,but also strengthen the judicial application of light punishment for pure administrative offenders,and also promote the socialization of punishment execution for pure administrative offenders.
