摘　　要：德国法学方法论的主导传统是萨维尼解释方法与制定法实证主义相结合的产物。这一传统使德国宪法裁判实践和方法论学说落入实用主义的窠臼。为克服由此而造成的法的具体化作业在论证水准、论证透明度方面的弱点,法学方法论应该超越这一传统,在法理论层面反思萨维尼解释方法的适用方式,摆脱制定法实证主义的影响,以规范性是一种结构化过程这一根本命题作为自身方法论总体立场的根本立足点。遵从此种规范概念的结构化法学方法论,不仅能够更为全面地分析宪法具体化过程中的所有要素,在诸种要素之间确立优先性等级、冲突秩序,也能因应宪法规定及宪法案件的特性促成分殊化的宪法具体化,从而提升宪法具体化工作的论证水平、论证透明度和论证细密度,为可复核、可批判的宪法具体化提供尽可能的工作指引。The leading tradition of German jurisprudence methodology is the product of the combination of Savini's interpretation method and the positivism of enactment law.This tradition makes the constitutional judicial practice and methodology of German fall into the pattern of pragmatism.In order to overcome the resulting weakness in the argumentation level and transparency of the concretization of law,the jurisprudence methodology should go beyond this tradition,reflect on the application of Savigny’s interpretation method at the level of law theory,get rid of the influence of the positivism of enactment law,and take the fundamental proposition of normativity as a structured process as the fundamental standpoint of its overall methodological position.The structured jurisprudence methodology that follows this normative concept can not only analyze all the elements in the process of constitution-concretization in a more comprehensive way,establish priority levels and conflict order among various elements,but also promote constitution-concretization with special components according to the characteristics of constitutional provisions and constitutional cases,so as to improve the level of argumentation,transparency and fineness of argumentation in the work of constitution-concretization.Make it as easy as possible for a reviewable and critical constitution-concretization.
