摘　　要：随着我国海底电缆管道的线路数量不断增加,涉及海底电缆管道的违法行为时有发生,海底电缆、光缆断缆和海底管道泄漏事故频发,甚至造成了严重的海洋生态环境污染,给社会和人民带来不可估量的经济损失。本文梳理了我国海底电缆管道保护管理立法现状和管理现状,分析了造成海底电缆管道运行安全危害的原因;针对当前我国海底电缆管道管理缺乏廊道规划等专项规划、保护管理手段比较单一、对违法行为处罚力度较低、未形成系统完善的监督管理体系等问题,借鉴国内外海底电缆管道保护管理的经验,从编制海底电缆管道路由廊道规划、提高对违法行为罚款处罚力度、建立海底电缆管道监管制度体系等方面提出建议。With the increasing number of submarine cables and pipelines in our country,illegal activities occur frequently which lead to their breakdown or leakage,and even ecological environment pollution.By reviewing the current legislation and management practice of submarine cables and pipelines protection,this paper analyzes the reasons for their safety hazard.The reasons include lack of special planning such as route planning,relatively simple protection and management means,mild punishment for illegal behaviors,and imperfection of supervision and management system,etc.Based on the protection and management experience of submarine cables and pipelines at home and abroad,this paper puts forward some suggestions from the aspects of corridor planning of submarine cable and pipelines,strenthening penalties for illegal behaviors,and establishing supervision system.
