摘 要:本文以司法解释与司法判例对国有建设用地使用权性质判定的差异性为切入点,系统梳理了在计划经济向市场经济转变的大环境下,土地供应由无偿划拨变为有偿使用引起的土地供应主体的变化。同时,通过结合现行国有建设用地使用权出让制度及其延伸、土地要素市场化配置改革带来的划拨范围缩减趋势,探讨了国有建设用地使用权出让的营利性特点。从约定权利与法定权利区分的角度,对国有建设用地使用权出让合同的内容构成及效力进行了剖析。最后,本文结合城乡统一土地市场建设、要素市场化配置改革预期,提出构建多元化供地市场机制、建立健全公益性用地市场、优化土地使用权交易合同的改革思路,为全国统一土地大市场发展提供借鉴和参考。Starting from the difference of judicial interpretation and judicial precedent on the nature of stateowned construction land use right,this paper systematically sorts out the changes of land supply subject caused by the change of land supply from free allocation to paid use under the environment of the transition from planned economy to market economy.At the same time,by combining the current state-owned construction land use right transfer system and its expansion,and the reduction trend of the allocation scope brought by the reform of land element market allocation,the paper probes into the profit-making characteristics of state-owned construction land use right transfer.From the perspective of distinction between agreed rights and statutory rights,this paper analyzes the content composition and effectiveness of the contract for the transfer of state-owned construction land use rights.Finally,combining the construction of the unified urban and rural land market and the reform expectation of factor market configuration,this paper proposes the reform ideas of building a diversified land supply market mechanism,establishing and improving the public welfare land market,and optimizing the land use right transaction contract,in order to provide reference for the development of the unified national land market.
