摘　　要：《中华人民共和国刑法修正案(九)》增设“帮助信息网络犯罪活动罪”,目的是维护信息网络安全管理秩序。在严惩涉信息网络犯罪的背景下,刑法作业线不断提前,导致帮助信息网络犯罪活动罪在司法实践中出现了泛化适用的现象。司法实践通常采客观说立场,该立场在理论上具有合理之处,却不具备可操作性,仅因行为违反了规范而入罪,将使中立帮助行为处罚范围过于宽泛,也使此罪与彼罪间的界限模糊不清。从刑法的谦抑性和人权保障的角度出发,对网络犯罪帮助行为应实质出罪、合理分流治理。主观说不仅理论上具有合理性,在实践中亦可以合理限制中立帮助行为处罚范围,明晰此罪与彼罪的界限,相较于客观说而言更具可操作性。“Amendment to Criminal Law(IX)of People’s Republic of China”adds the crime of“aiding information network criminal activities”to maintain the order of information network security management.In the context of severely punishing information network crimes,the criminal law operation line has been continuously advanced,resulting in generalized application of the crime of aiding information network criminal activities in judicial practice.Judicial practice usually adopts an objective position,which is reasonable in theory but not operable,and criminalizing the act only because the act violates the norm will make the punishment scope of neutral assistance act too broad and blur the boundary between this crime and the other crime.From the perspective of the modesty of criminal law and the protection of human rights,the act of aiding cybercrime should be substantively criminalized and reasonably differentiated.The subjective theory is not only reasonable in theory,but also reasonably limits the scope of punishment for neutral aiding in practice,and clarifies the boundary between this crime and the other crime,which is more feasible than objective theory.
