论党内法规治理效能的三重来源

摘　　要：党内法规的治理效能有微观、中观和宏观三重来源。其中,规范效力是党内法规治理效能的微观来源。作为一类独立的治理规范,党内法规有着专门的调整对象和相对独特的调整方法,其效力渊源包括政治、规范和价值三个层面。制度优势是党内法规治理效能的中观渊源。党内法规具有鲜明的政治属性,吸收了中华优秀传统文化,其实施能够产生引领效应,这些都是党内法规制度优势的来源或表现。政治势能是党内法规治理效能的宏观来源。在功能上立足于“四个全面”战略布局、在实施保障上依托于坚持党的全面领导、在价值取向上服务于党的宗旨,分别构成党内法规治理效能来源的功能性、保障性和价值性政治势能。The governance effectiveness of intraparty rules and regulations of the CPC comes from three sources:micro,medium and macro.The normative effectiveness is the microscopic source of the governance effectiveness of intraparty rules and regulations of the CPC.As a kind of independent governance norm,the intraparty rules and regulations of the CPC have special adjustment objects and relatively unique adjustment methods.Their source of effectiveness includes three levels:politics,norms,and values.The institutional advantage is the medium source of the governance effectiveness of intraparty rules and regulations of the CPC.The institutional advantages’source or manifestation of the intraparty rules and regulations of the CPC are the distinct political attributes,the absorption of excellent traditional Chinese culture,and the leading effect of their implementation.The political potential energy is the macroscopic source of the governance effectiveness of intraparty rules and regulations of the CPC.The functional,guaranteed,and value oriented political potential energysources of the intraparty rules and regulations of the CPC are:based on the Four-Pronged Comprehensive Strategy in terms of functions,relying on adhering to the comprehensive leadership of the Party in terms of implementation guarantees,and serving the purpose of the Party in terms of value orientation.
