摘 要:民间文艺、民间文艺表现形式、民间文艺衍生作品具有层次上的区别。民间文艺属于宏观概念、公域概念,民间文艺衍生作品属于微观概念、私域概念。“民间”一词带有明显的阶层色彩,《著作权法》第六条“民间文学艺术作品”在公民社会语境审视下并不融洽,在司法实践中存在指涉混乱问题。如继续保留该条款,将之限缩解释为“民间文艺衍生作品”是贯彻“两创”方针的现实选择。承接该条款的行政法规或司法解释可以设置在先其他作品抗辩事由,畅通自愿许可使用路径,规定停止使用例外情形,明确公平责任承担方式,以此规范民间文艺开发秩序,提升民间文艺运用质效,消减知识产权私利性与民间资源公共性之间张力,助力我国从文化资源大国升级为文化产业强国。Folklore,folklore expressions,and folklore derivative works are hierarchically different.Folklore belongs to the macro concept and the concept of the public domain,and the derivative works of folklore belong to the micro concept and the concept of the private domain.Article 6 of the Copyright Law is not harmonious under the context of civil society,and confusing in judicial practice.If this provision is retained,the narrowing of it to mean that“derivative works of folklore”is a realistic choice.Administrative regulations or judicial interpretations that undertake this clause may set up defense grounds for other prior works,smooth the path of voluntary licensing,stipulate exceptions to stop use,and clarify the way of fair responsibility,so as to regulate the order of folklore development,improve the quality and efficiency of folklore use,reduce the tension between the self-interest of intellectual property rights and the publicity of civil resources,and help China upgrade from a country with cultural resources to a strong country in the cultural industry.
