摘 要:碳排放数据造假严重影响碳排放数据质量,不仅损害国家公信力,而且阻碍碳排放权交易体系的运行。通过社会信用体系来规制碳排放数据造假等违法违规行为体现了信用规制作为一种新型治理工具的价值,并具备充分的理论与制度依据。但实践中碳排放数据造假的信用规制仍暴露出诸多问题,集中于立法的缺位以及执行、监管机制的不足。结合提升碳排放数据质量与推进社会信用体系构建的现实需要,提出从碳排放数据造假的信用规制法律体系、信用评价联动体制机制、信用监管机制予以完善的优化路径,其中应蕴含绿色金融重要理念,旨在加快推进我国生态文明建设与经济社会可持续发展。Carbon emission data falsification seriously affects the quality of carbon emission data,not only damages national credibility,but also hinders the operation of carbon emission trading system.Regulating illegal behaviors such as carbon emission data falsification through social credit system reflects the value of credit regulation as a new governance tool and has sufficient theoretical and institutional basis.However,in practice,the credit regulation of carbon emission data fraud still exposes many problems,focusing on the absence of legislation and the deficiency of enforcement and supervision mechanisms.According to the practical needs of improving the quality of carbon emission data and promoting the construction of social credit system,this paper puts forward an optimal path to improve the law system of credit regulation,linkage system mechanism of credit evaluation and credit supervision mechanism from carbon emission data fraud,which should contain the important idea of green finance,in order to speed up the construction of ecological civilization and the sustainable development of economic society.
