监狱监管和社区矫正“监管”的异质性分析

摘　　要：社区矫正机构和监狱同样监管罪犯,但二者的“监管”是不能等同的。从《监狱法》对刑罚执行权和其他权能的赋权形式看,监狱刑罚执行权具有单一专属性,监管本身就是执行刑罚活动;社区矫正的权力行使是多元分权制,社区矫正中的“监管”是行政管理权的体现。监狱监管是刑罚执行活动和狱政管理的有机结合;社区矫正的“监管”是对社会危险成员的管控活动。监狱监管的监管者和被监管者地位是不平等的,是惩罚与被惩罚的关系;社区矫正中的“监管”是管理与被管理的关系。监狱的监管是事前强制规范,坚持以全面干预为原则,以不干预为例外;社区矫正的“监管”是事后干预,坚持以不干预为原则,以干预为例外。Community correction institutions and prisons supervise criminals similarly,but their"supervision"is not equated.From the empowering forms of the Prison Law on the power of penalty execution and other powers,it can be seen that the power of prison penalty execution has a single and exclusive nature,and supervision itself is the activity of penalty execution;The exercise of power in community correction is a diversified decentralization system,and the"supervision"in community correction is a manifestation of administrative management power.Prison supervision is an organic combination of penalty execution activities and prison management;The"supervision"of community correction is a control activity for dangerous members of society.The status of prison supervisors and those being supervised is unequal,and there is a relationship between punishment and being punished;The"supervision"in community correction is the relationship between management and being managed.The supervision of prisons is mandatory and standardized in advance,adhering to the principle of comprehensive intervention with no intervention as an exception;The"supervision"of community correction is post intervention,adhering to the principle of non intervention and intervention as an exception.
