摘　　要：地理标志是我国丰富的传统信息资源的一部分,也是国际条约承认和保护的知识产权。国际上不同国家在地理标志保护的理念和模式上有差异,规则协调的结果体现在TRIPs协议的相关条款,这也是我国履行各类国际经贸协议中地理标志保护义务的基础。在国内层面,地理标志的注册、使用、管理、执法、侵权救济等规则,因长期以来缺乏统一立法,制度散乱低效,且与普通地名商标、地域团体集证商标等相关制度交叉混杂,不利于推动品牌建设助力地方经济发展。应尽快统一立法规定合理程序和有效救济措施,对已有地理标志注册存量进行整合,消除一地多标现象,并由相关部门各司其职实行分类管理执法。Geographical Indications(GI)are part of China's rich traditional information resources and are also intellectual property rights recognized and protected by international treaties.Different countries have different concepts and models of GI protection,and the result of rule coordination is reflected in the relevant provisions of the TRIPS Agreement,which is also the basis for China to fulfill its obligations to protect GI in various international trade agreements.At the domestic level,the rules for GI registration,use,management,law enforcement,infringement remedies,etc.,have long lacked unified legislation,thus the system is scattered and inefficient;and it is cross-mixed with relevant systems such as ordinary trademarks including place names and regional collective trademarks,either group or certification ones,which is not conducive to promoting brand building and promoting local economic development.Reasonable procedures and effective relief measures should be provided for as soon as possible in unified legislation,the existing registered stock of GI should be consolidated,the phenomenon of multiple GI for one place should be eliminated,and the relevant departments should carry out categorical management and law enforcement according to their respective institutional functions and responsibilities.
