摘  要:海绵城市建设是当前解决城市洪涝灾害和水资源短缺的重要途径。在系统化全域推进海绵城市建设过程中,政府发挥着主体作用。在海绵城市建设法治化和依法落实政府生态环境责任方面,我国已经开展了有益探索。整体上看,现行政策法律体系对政府生态环境责任的界定不清晰,难以成为法律意义上的具体责任形式。应当借鉴循环经济立法经验推动海绵城市建设专项立法,将海绵城市建设中的政府生态环境责任纳入中央环保督察问责范围,完善有利于公众参与的信息公开和司法救济程序,构建符合海绵城市建设要求的政府生态环境责任体系。Sponge city construction is an important approach to address urban flood disasters and water resource shortages.In the process of promoting the construction of sponge cities in a systematic and comprehensive manner,the government plays a leading role.China has conducted beneficial explorations in the legalization of sponge city construction and the implementation of government ecological and environmental responsibilities in accordance with the law.However,the current policy and legal system lacks a clear definition of the government's ecological and environmental responsibility,which hinders the establishment of specific legal forms of responsibility.To promote sponge city construction,it is necessary to learn from the legislative experience of circular economy and enact special legislation for sponge city construction.The government's ecological and environmental responsibility in sponge city construction should be included in the scope of central environmental supervision and accountability.Additionally,it is crucial to improve information transparency and judicial relief procedures conducive to public participation,and establish a government's ecological and environmental responsibility system that meets the requirements of sponge city construction.
